About 7 years ago I was watching hockey at a local bar I think the Ducks were in the playoffs. I was sitting in the bar with my friends having dinner and drinks when a friend that I had not recently heard from called to see if I would stay until she got there, I said sure because we all knew each other.
We were having a great time and she joined us later. After the game we went to the patio to smoke a cigar. We ordered another round of drinks when the waitress extended her open palm to me, everyone got a big laugh but she wasn't kidding so I gave her my car keys. We all finished the next round and decided to leave, she came over and asked who was driving me home or did I need a taxi. My friend that had just joined us said she would get me home, I only lived a quarter mile away and she could take me home. That sounded good, she could take my car home and get me the next day.
I got in the passenger side and she started the car. She turned the wrong way and I told her. She looked at me with her big smile and said, "We haven't begun to party." and drove to the next bar.
Somewhere along the way my memory kicks out. I woke up sitting on the curb looking at my smashed car with her yelling at me to get into the driver's seat. I staggered into the seat as the police arrived and arrested me for a DUI.
That set the ball rolling for a series of events that I could only watch in horror. My finances had taken a turn for the worse and to save money I was carrying only the liability.
I bumped into a friend years later and we were talking and I mentioned that night. He looked at me and asked if I remembered seeing him that night and I said no. He said that he had stayed at the first bar till close but came over to where we had gone to see if they were still open and saw my friend and I drive out. I was sound asleep in the passenger seat. The accident happened about 10 minutes later on the way to my friends home twenty five minutes away.
I also learned that my friend had received a DUI a couple weeks before and she had not had anything to drink and wanted to party. She had someone drop her off knowing that I would get her home.
Sort of sad, but everything went downhill after that.
I told my attorney but he said nothing can be done unless she wanted to face the consequences and admit it. I knew she wouldn't.
